A resident of Florianópolis lost the Mega da Virada prize after his winning ticket expired. Despite claiming that the ticket was stolen, the Federal Court accepted the argument of Caixa Econômica Federal.
The judgment took place last Friday (07/12). According to the Federal Court, the winner was part of a lottery sweepstake and won R$ 11,420.27 in the Mega da Virada draw held on December 31, 2022.
However, the winning ticket was stolen along with other belongings of the lucky winner. Caixa Econômica Federal stated that it would not pay the amount to the man because the claim reached the bank 90 days after the draw, meaning the prize had already expired.
According to the case, the resident of Florianópolis filed a police report when he was robbed and presented it to Caixa, which denied the payment. He filed a lawsuit in the Federal Court on March 27, 2023, 86 days after the draw. The order requesting the bank's position was issued on March 28, 2023, 87 days after the draw. The bank's position was confirmed by the electronic process system on April 7, 2023, 97 days after the Mega da Virada draw.
On December 4, 2023, the bettor won the case. However, Caixa Econômica Federal appealed and had its argument unanimously accepted by the 3rd Recursal Panel of the Federal Special Courts of Santa Catarina.
"Since the citation was only made on 07/04/2023, the claim is time-barred," said Judge Antonio Fernando Schenkel do Amaral e Silva.
